By participating in a Picnic Path experience, you acknowledge and agree to the terms below. Please read this carefully as it affects your legal rights.
1. Assumption of Risk
You understand and agree that participation in a self-guided outdoor experience involves inherent risks, including but not limited to walking on uneven surfaces, weather exposure, navigation errors, interaction with the public, and encounters with unknown environments. You voluntarily assume all such risks.
2. Personal Responsibility
You are solely responsible for your safety, decision-making, and conduct throughout the experience. It is your responsibility to assess your fitness and ability to participate safely. You must use common sense, follow public safety rules, and act respectfully in public and private areas.
3. Third-Party Interactions
The Picnic Path may recommend or route you toward independent third-party businesses such as restaurants, cafes, or parks. We do not own or operate these businesses and are not liable for their services, food safety, operating hours, or staff conduct. Any issues with these businesses should be addressed directly with them.
4. Food Allergies & Dietary Restrictions
You are responsible for managing any food allergies or dietary restrictions. Always check directly with the food providers about ingredients and preparation. The Picnic Path does not guarantee allergy-safe environments.
5. Navigation & Clue Accuracy
Clues and directions are provided as best estimates and may vary due to construction, venue changes, or temporary closures. You acknowledge that some deviation or confusion may occur and that you are responsible for using discretion and independent judgment while navigating.
6. Emergencies
You understand that The Picnic Path does not provide on-site supervision. In case of an emergency, you are responsible for seeking appropriate emergency assistance or contacting emergency services.
7. Release of Liability
To the fullest extent permitted by law, you release and discharge The Picnic Path, its owners, employees, partners, and agents from any and all liability, claims, damages, or losses resulting from participation in our experiences, including personal injury, property damage, delays, or dissatisfaction.
8. Jurisdiction & Consent
This waiver is governed by the laws of Victoria, Australia. By participating, you consent to the exclusive jurisdiction of Victorian courts in the event of any dispute.
If you do not agree with these terms, you should not participate in a Picnic Path experience. By attending, you indicate full understanding and acceptance of this waiver.
